Lake Rancho Viejo is a secluded community in Fallbrook, California. Located in a rural area on the southeast corner of Hwy 76 and I-15, it is part of the Pala Mesa region and San Luis Rey River basin. Lake Rancho Viejo is a newer subdivision that was built in the 2000’s.

The Home Owners Association dues are low and everyone has ample amounts of privacy. Oceanside Shopping Center to Get New Construction

If you’ve driven past the corner of El Camino Real and Vista Way in Oceanside lately you’ve seen quite a bit of construction going on.  A major overhaul is in store for the outdated shopping center.

The project, unanimously approved by the cicamino05ty’s Planning Commission last year, involves the northern 13.7 acres of the 20-acre Town & Country shopping center.

The center had been empty and looked like a ghost town for several years.  During the past decade, the shopping center had become dilapidated, with vacant storefronts and large anchor stores moving out.

 Recently, 84,305 square feet of buildings have been demolished to make way for a revitalization of the center. The biggest building to come down was a movie theater that had been dark for at least two decades. In its heyday, the Camino North fourplex was the first multi-screen theater in coastal North County.  JoAnn’s Fabric, Target, Denny’s & Discount Tire are staying. In fact, the existing Target store, which is in a separate half of the property, at the corner of Vista Way and El Camino Real, will receive another 7500 square feet of indoor space.

The center’s owners have reported they will be building the largest new store for a WinCo Foods, which will be the second San Diego County location of the Idaho-based chain of 105 stores — opening their first last year in San Marcos.  WinCo is a discount store that seems to be a cross between Trader Joe’s and Costco because of its eclectic selection and items that are sold in bulk. The new Winco will take up the area between Target and Jo Ann’s.

Oceanside is excited for the revival of the center.  We are ready for a new shopping location.  It’s been a long time coming.

What Happens If You Die Without a Will In California

Who will inherit Prince’s $300 million plus fortune?  According to the laws in Minnesota, since Prince died without a will or trust, his estate would be divided between his sister and all of his half-siblings, who are treated like full siblings in that state.

But what happens if you die without a will in California?   The Torres Team thought it would be a good idea to give you some insight on the laws surrounding holding title in California.

Joint tenancy is a way of avoiding probate simply by putting the words “joint tenancy” in the title of an asset.

What is the right of survivorship? When a joint tenant dies, his or her interest in the asset vests in the surviving  joint tenant or joint tenants. In other words, if two people own real estate in joint tenancy, and one of them dies, the surviving joint tenant then owns 100 percent of the property.

Does a will or trust have any control over joint tenancy? If property is owned in joint tenancy, the surviving joint tenant will receive the deceased joint tenant’s interest in the property, regardless of what that person’s will or trust says about the property. An exception would be if both joint tenants died simultaneously, in which case their wills would control their interest in the asset.

If a California resident dies without a will or trust, they die “intestate” and the laws of intestate succession are used to determine who will inherit the estate.  Determining the heirs involves answering a series of questions about the person who died.

The first question is whether the decedent (the person who died) was married.

  1. If the decedent was not married, the estate is distributed as follows:
  2. To the decedent’s children, who take in equal shares if they are in the same generation.
  3. If there are no children or other issue (issue is the legal term for children, grandchildren, great-grandchildren, etc.) living, the estate goes to the decedent’s parents.
  4. If there are no parents living, the estate is distributed to the “issue of the parents.” If the decedent had brothers or sisters, they will inherit the estate. If there are deceased brothers and sisters, and they had issue, the issue will inherit the share of the estate that the deceased brother or sister would have inherited.
  5. If there are no brothers or sisters, the decedent’s grandparents will inherit the estate.
  6. If there are no living grandparents, then the “issue of the grandparents” will inherit the estate. This could include the decedent’s aunts and uncles, or if there aren’t any aunts and uncles, the decedent’s cousins. Generally, the oldest generation that has surviving issue will inherit, but if there are deceased issue in that generation, their issue will inherit their share.
  7. If there are no cousins, Probate Code section 6402 provides that the estate will be distributed to “next of kin in equal degree,” generally meaning more distant cousins.

Arizona-Probate

  1. If the decedent was married, the first question is whether the decedent owned community property, separate property, or a combination of the two. Community property is generally defined as the assets acquired during marriage from earnings or salary. Separate property is generally defined as assets brought into the marriage when the decedent got married, inheritances to the decedent, or gifts to the decedent.  However, California case law provides many exceptions to these definitions, and assets can change from community to separate property, or from separate to community, by combining assets, by improving separate property with community property, or by written agreement of the spouses, for example.

 

  1. The decedent’s community property goes to the surviving spouse, who may have to file a spousal property petition to establish ownership.
  2. The decedent’s separate property is distributed as follows:
  3. The surviving spouse receives all of the separate property if the decedent is not survived by issue, parents, brothers, sisters, or children of a deceased brother or sister.
  4. The surviving spouse receives one-half of the separate property if the decedent had only one child, or issue of a deceased child.
  5. The surviving spouse receives one-half of the separate property if the decedent left no issue, but left parent(s) or their issue.
  6. The surviving spouse receives only one-third of the separate property if the decedent left more than one child.
  7. The surviving spouse receives only one-third of the separate property if the decedent left one child and the issue of one or more deceased children.
  8. The surviving spouse receives only one-third of the separate property if the decedent left the issue of two or more deceased children.

 

However, all of the above considerations are irrelevant if the decedent had a will or living trust.   It is highly advisable to speak with an Estate Planning Attorney.

The Torres Team Client Appreciation Party

When my team and I were trying to come up with a way to let our clients know we appreciate them, we knew we had to go big or go home.  We decided to throw them a party.  But not just any party, we wanted something fun and memorable.  That’s when I decided to contact my brother-in-law, Peter Zien, owner of AleSmith Brewing Co. and told him about our plan.  That’s when the planning and fun began!

I contacted our vendors, Loan Officer, Kelly Kline from One Trust Home Loans, Keith Badiner from Farmer’s Insurance and Shirley and Alessio Indegno from Bow Electric General Contracting .  They set up some booths at the event and were easily accessible for our clients to engage with them during the party.

I had some raffles  going for those who participated in some of our games. For instance, I wanted to make sure our vendors were approached at the event, so I made up a card that had the vendors name on them.  If our guests approached all three vendors, they would get a raffle ticket for a chance to win some really cool prizes!   The giveaway for this specific game was a one night stay at The Hard Rock Hotel in San Diego (courtesy of our lender).  I also asked our clients to post the event on their social media with the hashtag #TheTorresTeam to gain some exposure and in return they received a raffle ticket good for a photo session at location of choice, courtesy of Wendy Childress photography.

 

We hired Wendy Childress Photography to take photos of everyone.  She put together a really fun photo booth with fun props and signs. She also captured some very cool candid shots of everyone having a great time.  We also had a videographer there, Craig Meyer from Show Business Media. We will get that video very soon and share that as well.

If you’ve ever sold a home, you know it takes money to make it happen. You’ve got to fix and freshen it up to attract buyers. Then there are closing costs. And moving brings its own set of expenses.

But perhaps the biggest chunk that comes out of your pocket is the real estate agent commission, which traditionally runs around 6%. For the typical “For Sale by Owner” (FSBO) home—which sold for $208,000 last year—that’s almost $12,500. Ouch!

With that kind of cash, it’s no wonder that many sellers fly solo in an effort to save a few bucks. But is it worth it?

Your home is a big investment, and you want to make the most of it. Keeping the agent commission all to yourself seems like an easy way to do that. The problem is you’re leaving even more money on the table by opting out of a pro.

How much more?

According to the National Association of Realtors (NAR), the typical home sold by an agent last year fetched $235,000. That’s a $27,000 difference!

Selling your home on your own doesn’t necessarily mean an agent-free transaction. You still owe it to the buyer’s agent to pay their commission. After all, they worked hard to get their buyer into your home. If they get 3% of the sale, you can cut your $12,500 in savings in half, leaving you $6,250.

The numbers alone paint a pretty compelling picture.

There’s Power in Numbers

If you want to sell your home, you’ve got to go where the buyers are. A recent NAR report found that 88% of buyers used a real estate agent to purchase their home in 2014.

Last we checked, yards signs don’t exactly have their finger on the pulse of the market. Think about how many people drive by your home on a given day. Then stack that up against an agent’s pool of buyers. There’s no comparison!

With a real estate agent, you get instant access to thousands of potential buyers through the Multiple Listing Service (MLS). A great agent has a proactive plan for exposing your home to as many buyers as possible and works with you to ensure your home gives a great first impression.

There’s No Substitute for Experience

Let’s set the sugarcoating aside and cut to the chase. Going it alone guarantees one thing: You’ll make mistakes. Some will be small—but some will come with zeroes on the end. You’ve worked too hard to let that happen!

Research shows FSBO sellers struggle most with paperwork, pricing and preparing their home for the sale. A real estate agent can help you with all of those things (and more!) and will advise you based on experience, not emotion.

Here are just a few ways a pro makes selling your home a cinch:

  • Pricing your home based on the latest market data
  • Actively marketing your home to buyers
  • Scheduling showings with potential buyers
  • Negotiating to get the best price on your home

10 Questions to Ask Your Lender

A house is likely your most valuable asset, so it’s a good idea to know as much as possible about your mortgage before you rush toward closing day.

When you meet with a mortgage lender, here are 10 questions you should ask to ensure you’re clear on what your options are when buying a home.

1. What mortgage types do you offer?

Different mortgage lenders offer different types of mortgages. These can loans differ in the amount offered, interest rates, length and payment type. Common mortgage types include the following:

Your mortgage lender should be able to answer this question once you’ve completed an application and the lender takes stock of your employment, income, assets, credit, debt, expenses, down payment and other information about your finances.

3. What are the full costs of my mortgage?

This will be available to you via a Good Faith Estimate, or GFE, which is a line-by-line estimate of mortgage costs. Use this as a shopping tool to compare rates and expenses from various lenders.

When you’re ready to close, a finalized document called a HUD-1 settlement statement will be given to you.

4. When will I get the HUD-1?

By law, you have the right to receive the HUD-1 a day before closing or settlement.

5. What documents do I need?

Proof of income and assets, personal identification and information about your credit history are the big three. It can be a lot of paperwork, so start now by getting your paperwork in order.

6. What are the qualifying guidelines for this loan?

Many mortgage lenders require borrowers to meet certain guidelines. For example, VA loans are only available to eligible veterans, while qualifying mortgages have their own list of restrictions. Your lender will be able to tell you which loans you qualify for.

7.  Who will be the title and escrow agency?

You don’t have to leave selection of the title company up to the lender. See how much your mortgage lender’s recommendation will cost, then shop around and see if you can save any money.

You can do the same for an escrow agency and attorney.

8.  How long will it take to process my loan application?

The answer depends on how quickly you supply the required documents, the mortgage lender’s workload and the demand for inspectors, appraisers and other professionals involved. In general, it can be a few weeks to a couple of months.

9. What can I do to avoid slowing down the process?

While your mortgage lender will have specific recommendations to ensure speediness, here are some general recommendations:

  • Fully complete all required documents.
  • Be readily available to answer any questions.
  • Be prepared to explain any past credit issues.
  • Go over your credit report for errors.
  • Do not take on any new debts, switch jobs or change careers during the process.

10.  What are the chances my loan will get sold?

There’s no way to tell, but if it does happen, don’t panic—it’s normal.

If it happens, the old and new servicing companies must notify you in writing of any changes so you know who to pay and how to proceed.
